Terms & Conditions

1. Definitions

Gabriq: trading name of Gabriq V.O.F., Located in Valkenswaard, Netherlands, registered with the Dutch Chamber of Commerce under number 98661353. All agreements are concluded with Gabriq V.O.F.
Consumer: any natural person purchasing products via the webshop who is not acting in the course of a profession or business.
Agreement: any order or purchase made via the webshop.
Products: all items offered by Gabriq.

2. Applicability

These Terms & Conditions apply to all orders and offers from Gabriq.
Placing an order signifies acceptance of these Terms & Conditions.
Deviations from these Terms & Conditions are only valid if expressly agreed in writing, including by email, by an authorized representative of Gabriq.

3. Offers & Prices

All offers are made with due care. Gabriq is not bound by agreements based on objectively obvious typographical, calculation, or pricing errors that a reasonable consumer could have identified.
Prices are in EUR, including VAT, excluding shipping costs unless stated otherwise.
Prices and product information may change; confirmed orders are not affected.

4. Orders & Agreement

An agreement is concluded when an order is placed and confirmed by email.
Gabriq may cancel an order after confirmation only in the event of stock shortages, objectively obvious errors in price or product description, or confirmed fraud. In such cases, the consumer will be informed without delay and any payment will be refunded.
The consumer is responsible for providing correct contact and delivery details.

5. Payment

Payments are processed via third party payment providers. Gabriq remains the point of contact for the consumer but is not liable for delays or errors attributable to the payment provider, provided Gabriq has acted with due care.
Orders are processed after full payment.

6. Delivery & Risk

Delivery is made via postal or courier services. The risk of loss or damage passes to the consumer upon physical receipt. In the event of loss or damage during transport, Gabriq will investigate with the carrier before proceeding with replacement or refund.
Delivery times are indicative. If delivery is delayed beyond a reasonable period, the consumer must first grant Gabriq an additional reasonable delivery period before exercising any right to dissolve the agreement.
Shipping costs depend on the destination and are communicated before checkout.

7. Returns & Inspection

The consumer may inspect the product as in a physical store. Inspection is limited to what is reasonably necessary to assess the nature, characteristics, and functioning of the product.
Removing protective seals, plastic wrapping, hygiene seals, or any other original sealing intended to prevent use or preserve resale value is considered use beyond what is necessary for inspection. In such cases, Gabriq reserves the right to deduct any resulting depreciation or refuse a full refund.
To exercise the right of withdrawal, the consumer must notify Gabriq within 14 days after receipt by an unequivocal statement. Notification can be made via the contact page on our website or by email. No withdrawal form is required.
Refunds will be issued within 14 days after receiving the returned product, subject to the above conditions.

8. Warranty & Safety

Warranty does not cover damage resulting from impact, cracks, delamination, moisture, heat exposure, normal wear and tear, or improper storage or maintenance.
Gabriq products carry statutory warranty, ensuring they perform as reasonably expected.
Products are designed exclusively for recreational and competitive padel. Use outside this purpose or contrary to instructions is at the consumer’s own risk.
Gabriq is not liable for damage resulting from use contrary to instructions, including but not limited to use outside padel play, use despite visible damage, or failure to use safety accessories such as wrist straps. This does not affect liability for defective products under mandatory law.
For children: use only under adult supervision.

9. Force Majeure

In case of force majeure, Gabriq may suspend its obligations. If performance becomes permanently impossible, the agreement will be dissolved and payments made will be refunded within a reasonable period after the force majeure situation has ended.
Force majeure includes, but is not limited to, natural disasters, pandemics, strikes, war, transport issues, or communication network failures.

10. Intellectual Property

All rights to the website, products, images, texts, logos, and designs belong to Gabriq.
Nothing may be copied or used without written permission.

11. Disclaimer

Gabriq strives to ensure that all information on the website is accurate and up to date. Obvious errors or mistakes do not bind Gabriq. This does not affect liability for misleading information or mandatory consumer rights.

12. Privacy & Personal Data

Personal data is processed in accordance with the GDPR.
Data is used solely for: fulfilling orders, improving services, and marketing communications with the consumer’s explicit prior consent, which may be withdrawn at any time.

13. Complaints & Disputes

Complaints must be reported within a reasonable time to info@gabriq.com.
Gabriq responds within 14 days.
Disputes with consumers may be submitted to the competent court at the consumer’s place of residence. Dutch law applies to all agreements.

14. Limitation of Liability

To the extent permitted by law, any liability of Gabriq is limited to the amount paid by the consumer for the product concerned, excluding liability for intent, gross negligence, or personal injury.

15. Final Provisions

Gabriq reserves the right to amend these Terms & Conditions. Amendments do not apply to agreements concluded prior to the change.
